1. Terms of Service and Liability Agreement
Adding a mandatory “I agree to the Terms of Service” checkbox before checkout can help demonstrate that the customer actively accepted the store’s policies.
Because NatureRails products are structural, customized, and made to order, the agreement should clearly address:
- Installation responsibility
- Local building-code requirements
- Custom-order cancellation and refund restrictions
- Freight inspection and delivery damage
- Third-party contractor workmanship

“I agree to the Terms of Service, including the Custom Order Policy, Shipping and Delivery Terms, and the Building Code and Installation Liability Waiver.”
The words “Terms of Service” should link directly to the Shopify Terms of Service page.

Welcome to NatureRails LLC. By purchasing our custom-designed steel railing panels, inserts, gates, or other architectural products, collectively referred to as the “Products,” you agree to the following Terms of Service.
1. Governing Law
NatureRails LLC operates from the State of Florida, United States.
These Terms and any purchases made through shop.naturerails.com shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
Any legal action arising from a purchase must be filed in an appropriate state or federal court located in Florida.
2. Building-Code Compliance and Safety
NatureRails decorative 10-gauge steel railing panel inserts are designed to comply with common United States building-safety requirements, including the 4-inch sphere opening requirement, when installed correctly.
However, building codes may vary by state, county, city, municipality, and project type.
The buyer is solely responsible for confirming that the selected design, dimensions, materials, mounting method, and installation plan comply with all applicable local, regional, and state building codes before purchasing or installing the Products.
3. Installation Responsibility and Liability Waiver
NatureRails LLC is a product manufacturer and is not an installation contractor. NatureRails LLC does not perform, supervise, approve, or certify installations.
The buyer assumes full responsibility and liability for the installation and use of the Products.
NatureRails LLC shall not be held liable for any direct, indirect, incidental, punitive, special, or consequential damages, injuries, losses, code violations, or structural failures resulting from:
- Improper installation
- Incorrect measurements
- Unauthorized modifications
- Failure of wood, metal, masonry, posts, handrails, frames, or other supporting structures
- Improper fasteners or mounting systems
- Third-party contractor negligence or workmanship
- Failure to comply with applicable building codes
NatureRails LLC strongly recommends hiring a licensed, bonded, and insured contractor, fabricator, professional welder, or qualified installer.
4. Custom and Made-to-Order Products
NatureRails railing panels, gates, and related products may be custom-fabricated, precision-cut, and powder-coated according to the buyer’s selected dimensions, design, finish, or other specifications.
Because these Products are customized and made to order, all sales are final once production has started.
After production begins:
- Orders cannot be cancelled.
- Orders cannot be refunded.
- Product dimensions, designs, finishes, or specifications cannot be modified.
- Returns and exchanges are not accepted for custom-sized or custom-fabricated Products.
An exception may be considered when NatureRails LLC verifies that the Product contains a manufacturing defect.
5. Shipping, Freight, and Delivery
Heavy or oversized orders may be delivered through freight companies or third-party carriers, including uShip.
Shipping may be coordinated by NatureRails LLC on behalf of the customer, but delivery services are performed by independent third-party carriers.
The buyer or recipient must inspect all Products and packaging for visible damage before signing the delivery receipt.
Any visible damage must be clearly documented on the carrier’s delivery receipt before the delivery is accepted.
If the delivery receipt is signed without noting visible damage, NatureRails LLC cannot guarantee that a freight-damage claim, replacement request, or reimbursement request will be approved.
Customers should also photograph the packaging and Products immediately if damage is discovered.
